Take to heart, it can be BPE miss, and resisted?

It seems to me that a skill that can be BPE, and miss shouldn't also be resistable, make it physical or tactical, but both in terms of avoidance? I don't think it should be that way imo.

i was fighting that giant in the pits a couple days ago and had this weird thing of using take to heart and the skill would execute (i looked later in my log and it listed damage), but it didn't go to a cooldown. i could literally spam it if i wanted.

i'm fine with certain bosses being immune to it, but if this happened on normal overworld monsters, i would be pretty annoyed. is that the case? i've noticed it missing a lot more lately, but haven't bothered to check if it was resisted instead of just BPE

I find it getting BPE'd a lot, especially by Creeps.
I feel the legendary is kind of useless as the blue-line capstone.

to the OP:

I think this skill actually is made out of 2 skills, so mobs can b/p/e the melee damage, and can resist the power drain. If the drain is resisted the damage wil just be dealt, visa versa i think that it wont power drain if b/p/e'd.
