Pretty much what Pontin said. Part of the reason we changed the structure with Mordor, from what I'm told. Some of those items we could potentially try and put in other places, but a lot of stuff is locked down to folks who were there then.
A few years back Cordovan explained (As best as he could, and you'd have to speak a bit of Cordovian), that it was legal based on federal US and Massachusetts laws..... if an item was marked as "exclusive" when it was included with a sale, that "exclusive" item can by law not be supplied in any other way later. This goes for both physical goods as well as virtual goods.
I guess with Mordor and up, SSG changed the legal language in such a way that they could. I doubt anyone would sue SSG (although there might be some disgruntled player with a pocket lawyer) if they now turned around and started selling or giving away exclusive items from those older expansions, but technically speaking they would be breaking some commerce laws and could be held liable.
